LG Vs Delhi CM: Anti-Kejri posters seeking resignation placed by BJP

New Delhi: Many anti-Kejriwal posters seeking Delhi Chief Minister’s resignation were seen across the capital on Friday morning. The posters were reportedly placed by The Bhartiya Janta Party (BJP) after High Court pronounced its judgement over the power tussle between the Lieutenant Governor Najeeb Jung and Chief Minister Kejriwal, which came as a major setback to AAP.  Delhi HC in its judgement held that “L-G is the administrative head of National Capital Territory” and not the Chief Minister Arvind Kejriwal. “L-G is not bound to act as per advise of Delhi Cabinet”, the court said. The High court also said that “AAP Government’s contention that L-G is bound to act on advice of Council of Ministers is without any substance and cannot be accepted”. As per the HC, “The May 21, 2015, notification of Centre barring ACB from proceeding against Central Government employees is neither illegal nor unsustainable”. The court in its judgement said that Article 239 continues to remain applicable that makes Delhi a Union territory. Delhi High Court held that, “Council of Ministers cannot take decision without referring to L-G first”. Delhi High Court also said that “No Action can be taken by ACB against Central Government officials”. Also, “Service matters fall outside the jurisdiction of Delhi Legislative Assembly and L-G exercising the powers is not unconstitutional”. HC order is based on 9 PILs filed in the court amid constant tug of war between the two.
