Detailed FIR copy & allegations levied by CBI against Lalu, family

  1. CBI complaint accuses Lalu Yadav of committing misconduct by colluding with owners of Chanakya and Sujata hotel at Patna through IRCTC officials Sarla Gupta and PC Gupta in granting sub lease of the rights of 2 Railway hotels at Puri and Ranchi to Sujata Hotel Pvt Ltd.
 
  1. The further allegations state that- Lalu Yadav entered into criminal conspiracy with Harsh Kochhar and Vinay Kochhar of Sujata Hotel Pvt Ltd, Patna, Sarla Gupta and IRCTC officials with subject of causing undue pecuniary advantage to him and others.
 
  1. It further states that as per inquiry- Harsh and Vinay Kochhar on February 25, 2005 sold prime commercial property in the form of land measuring about 3 acres in Patna through 10 sale deeds for Rs 1.47 crores (approx) to Delight Marketing Company Pvt Ltd in which Sarla Gupta was a front benami holder for and behalf of Lalu Yadav
 
  1. As per CBI inquiry- Not only such land was sold at a price which was much below the prevalent circle rate as well market rate, such properties were also falsely shown as ‘agriculture’ land instead of commercial land to evade the substantial stamp duty and thereby causing loss the State Government Exchequer.
 
  1. Inquiry also states that - though the land in question was sold by Kochhars to DMC, the payment was arranged surreptitiously by the company in the form of investment in the shares of DMPCL and its promoter BS Ahluwalia. Also, on the day when sale deeds were executed by Kochhars in favors of DMCL, The Railway board on the same day informed IRCTC about its decision for transfer of BNR hotels to IRCTC on “as is where is basis”
 
  1. Further allegations on Lalu state that – Lalu Yadav colluded with PK Goel, the then MD of IRCTC and got two BNR hotels transferred to Sujata Hotels of Kochhars through a rigged and manipulated tenders process which was managed by PK Goel.
 
  1. The CBI inquiry further states that- the official communications of Railways board marked to Lalu Yadav and the instructions given by Lalu to Chairman Railway board during 2004-2006 indicate that Lalu as Railway Minister was aware of whole matter and was keeping a track of tender proceedings initiated by IRCTC.
 
  1. As per CBI, further inquiry discloses that tenders for development, operation and maintenance of BNR hotels at Ranchi and Puri were awarded to Sijata Hotel, owned and controlled by Vijay and Vinay Kochhar; and after Lalu demitted office, shares of DMC were transferred from Sarla Gupta to Lalu’s wife Rabri and son Tejashwi Yadav.
 
  1. As per CBI probe- the inquiry revealed that Lalu whle serving as Railways Minister, and his family abused his position for causing undue favour to Kochhars and therefore a high value premium land was acquired through their benami company DMCL.
 
  1. CBI has therefore ‘disclosed’ commission of offences under various sections Including Criminal conspiracy and Money laundering act.
